The legal rights in UAE you should know
Question: While I was on my annual leave, vacationing in my home country, I got the letter of redundancy from my employer. My annual leave got over on March 30, and I was supposed to return to the UAE. But because of the coronavirus pandemic I couldn’t come back to the UAE. My employer told me that the company is facing huge financial crisis and the company cannot pay my full salary. I wanted to know, can my employer sack me while I am in my home country on an annual leave? Can my residence visa be cancelled by the employer while I am not in the UAE?
Answer: To answer your first query, please note that as per the Employment Law, an employer may not terminate a worker/employee while he is away on annual leave. This is as per Article 90 of the Employment Law.
Also, your employer is supposed to pay you the leave salary before you head to your home country for vacation on annual leave. Article 80 of the Employment Law states this rule.
