Woman in UAE seeks inheritance 27 years after husband’s death, court refuses

The defence lawyer argued that the widow is not entitled to file the case because it has exceeded the set time frame for lodging it.

An Arab widow approached the Personal Status Court in Ras Al Khaimah to get the inheritance of her husband 27 years after his death. However, the court turned down her claim and ordered her to pay the court charges and lawyer’s fees.

In her pleading, the woman contended that the son of her husband’s other wife, who is also an Arab, has solely inherited the property, including four houses, and deprived her of her legal share. She added that the title deed of the property has been transferred to his son, the defendant.

“I would like to have my legal share in the inheritance of my late husband,” she requested the court, submitting the documents that proved her husband’s death and the list of heirs.

The defence lawyer argued that the widow is not entitled to file the case because it has exceeded the set time frame for lodging it.

“She does not also have any capacity to file the case,” she added.

“My client did not inherit the mentioned property. He rather got it as a grant from the government,” she explained, showing the court the title deed of the property.

“This property is a gift that can not be gifted to others while the title deed of the same may only be transferred to his (defendant’s) legal heirs.”

The court rejected the widow’s plea, and asked her to pay the court charges and lawyer’s fees.
